For example, I recreated the Feuerkrieg logo using symbols available on Commons (Brandenburger division logo and totenkopf). Is this unacceptable? @RKT7789 Don't apologize, you did it in good faith. The totenkopf is PD because it's old, but it depends, how complicated is the Brandenburger division logo? A good rule is to read the COM:ToO for whatever country it originates from, and the US. PARAKANYAA (talk) 00:31, 26 May 2025 (UTC)Reply

@RKT7789 Okay, that's over the ToO, but the fact that appears to be an official Nazi Germany symbol complicates it. Combining those two is not particularly creative so in combination it would be fine. I am still not entirely certain but without further investigation of the copyright of German war symbols (the creator very likely did not survive World War II, making it expired) it would be hard. I stand by my opinion. Given the way law enforcement operates in the US there is literally no way this was not published with the permission of the creators. That's like saying well, this same mugshot in a newspaper without notice was done without permission - no, they gave it to them with that expectation.
IMO any image that was on a wanted poster is fair game pre-1989, because mugshots were usually not otherwise published and FBI wanted posters did not have notice. And if they were published elsewhere they're almost certainly PD because I have never, not once in my life seen a newspaper mugshot include a proper copyright notice. So we have to delete any ambiguous non FBI works from 1990 to present but anything before that was published without notice. PARAKANYAA (talk) 03:32, 8 July 2025 (UTC)Reply

@Trade These are all mugshots/law enforcement photos pre-1989, which is the only kind of photo I am applying this argument to. More recent ones should be deleted or ones that are not clearly from law enforcement, like Boelter. PARAKANYAA (talk) 03:39, 8 July 2025 (UTC)Reply

@Trade If it is a law enforcement photo, they would still be given access to the photo because law mandates interagency cooperation and information sharing. The problem is that doesn't transfer the copyrights - but back then, if the first publication was not with notice, it expired. Dont we need to know when and where the first publication was in order to conclude there was no notice? Obviously the photos weren't taken for the explicit purpose of FBI Most Wanted posters so there must have been some other context behind their first publication Trade (talk) 03:49, 8 July 2025 (UTC)Reply
@Trade No, usually not. Mugshots are for an internal purpose, identifying inmates; most of the time, they would go unpublished as that is internal, unless an inmate happened to go on the run or such, when they would be published. Most mugshots were not published in the past, and if they are, it's in the newspaper, where they would have the same case (e.g. they would not carry a copyright from the newspaper so they would expire due to lack of notice unless there was a separate copyright, which i have never seen once in my entire life, ever), but most of the time they weren't published at all. Unless there is a prior newspaper publication the wanted poster is almost certainly the first publication - and if we have record of a newspaper publication pre 1989 it's almost certainly PD anyways. @Trade Non-federal jurisdictions can claim copyright in the US, except for California and Florida, who abdicated it in most cases.
On that: I don't actually think there is much established precedent for mugshot copyright. They are all made to an official, specific formula with no human creativity, to the point where there is no creativity whatsoever, so there is an argument that there is no human input and so fall under the ToO. This is the law in France, for example.
I think a police department in Utah (?) tried to claim mugshot copyright but other than that there is very little precedent and I'm not sure how successful that was. Funnily enough this got brought up with the Trump mugshot, of all things. I do not think a copyright has ever been officially granted to a mugshot by the copyright office, though I could be wrong. All in all too little American precedent to decide, so I wouldn't try to push it on commons. PARAKANYAA (talk) 04:00, 8 July 2025 (UTC)Reply

Ah! That's the best news this could be, thanks for finding this photo and tracking down the copyright info. Too bad he's covering his mouth, but still, tough to complain about a reasonable resolution PD photo from 1980, those are hard to come by. I might be able to find a better one. He was covered in a lot of small-time papers that didn't bother to copyright their issues. Sadly, those small-time papers tend to have really trashy scans available, so none of the ones I saw were great. May look more in the future. PARAKANYAA (talk) 22:35, 1 October 2025 (UTC)Reply
Sounds great. My copyright database search knowhow ends in 1963, so glad you're doing the work. If you find him in Oregon papers, let me know and I can see whether the local library maybe has print archives. They did a few year ago, at least for some of the smaller papers.
